Brigade Enterprises Limited has publicly objected to the revocation of Environmental Clearance for its residential project 'Brigade Morgan Heights' in Perumbakkam Village, Chennai, by the State Level Environment Impact Assessment Authority (SEIAA).
Brigade stated that the revocation is legally unsustainable, factually incorrect, and arbitrary. The project site is on private patta lands classified as dry lands in revenue records since 1935, and Brigade entered into a Joint Development Agreement with the landowner in 2022. Public notices were issued by Brigade at the time of securing the clearance, and no objections were received.
The Environment, Climate Change and Forest Department clarified in October 2025 that the lands are private patta lands with final wetland boundaries undecided. The Madras High Court dismissed a Public Interest Litigation against the project in February 2026, concluding that until ground truthing is completed in the Ramsar process, the lands cannot be conclusively designated as wetlands.
The cancellation order, issued on May 12, 2026, was based on a generic condition in all SEIAA clearances, but Brigade argued it is not applicable as the lands are not declared wetlands. The SEIAA convened a meeting on May 8, 2026, and issued the order without providing Brigade any prior notice, personal hearing, or opportunity to submit evidence.
The proposed Ramsar site and its zone of influence covers over 11,000 acres in South Chennai, impacting other projects and private landowners as well. Brigade is appealing against the order and exploring all appropriate legal and regulatory remedies.
